DEC 21589 <br />BOOK <br />i <br />61C <br />Attorney O'Haire pointed out that Lots 2 and 3 have houses on <br />the ocean side <br />owned by Mr. & <br />owned by Mr. & <br />and on the river side. Lot 3, east of AIA, is <br />Mrs. Preston; Lot, 3, west of AIA , and Lot 4 are <br />Mrs. Thompson. So, they have been divided and <br />there are houses on each according to the Property Appraiser's <br />records. Lot #1, west of AIA, is owned by Mr. & Mrs. Olson, who <br />have built a house there. Lot #1, east of AIA, is owned by Mrs. <br />DeCosgrow, who also has built a home. Attorney O'Haire emphasized <br />again that we are only talking about these 5 lots that are zoned <br />RS -3 and can accommodate a house on either side of the road. This <br />entire thing was prompted when his client made an inquiry as to <br />whether or not they could build on either side of the road after <br />receiving an offer to <br />undersized lot." <br />Attorney O'Haire <br />purchase, and staff said "no, you have an <br />next addressed the question of whether <br />Ocean <br />Boulevard was located differently than AIA. As you go north of <br />his client's property, there is a zoning change, and it becomes so <br />narrow it is very unlikely it could be used on either side in any <br />case. The County Attorney's office has issued an elaborate <br />opinion saying these lots were not divided or split when AIA was <br />built in the 1950s, but were divided or split in the 1980s when <br />all these people acquired title to them and were given deeds for <br />parcels east and west of AIA. Attorney O'Haire maintained that <br />what really split those lots was the construction of AIA, and he <br />felt to say to those people who own property on either side of the <br />road that they can build on only one side of road really defies <br />all reason. In fact, Ralph Lindsey, chairman of the Board of <br />Adjustments, commented that this really doesn't make a lot of <br />sense. With regard to traffic, Attorney O'Haire didn't feel the <br />additional <br />really are <br />and Lots 2 <br />curb cuts would really impact the road because we <br />not talking about curb cuts north of these deeper lots, <br />and 3 already have curb cuts. He felt this is a unique <br />situation. If there is a wetlands concern, it should be addressed <br />36 <br />
