The contract provides 425 calendar days for construction and <br />includes certain language that Assistant County Attorney Sharon <br />Brennan Phillips desired to protect the interests of the County as <br />well as to preclude a repeat of events that occurred with Phase II. <br />It is anticipated that the facility will be completed in February, <br />1991, and a Notice to Proceed will be issued on December 22, 1989, <br />if approval of the contract is achieved. <br />The bid for construction of Phase III was awarded to Robert F. <br />Wilson Construction Company on November 17, 1989, in the amount of <br />$5,103,000. Staff recommends approval of the contract and requests <br />that the Board authorize the Chairman to execute the necessary <br />documents so construction can be initiated. <br />ATTACHMENTS <br />Four (4) original copies of Contract for construction of Phase III <br />Commissioner Scurlock questioned the adequacy of the wording <br />on the bottom of page two of the contract where it reads: "Five <br />Hundred Dollars ($500.00) for each and every calendar day during <br />which the work is not complete beyond the limit set forth above <br />will ]be assessed." He wondered if it should say $500.00 a day and <br />that each day is a new occurence. <br />Assistant County Attorney Sharon Brennan felt that the <br />wording of "each and every day" is sufficient, and Attorney <br />Vitunac advised that Attorney Brennan is our expert in <br />construction contracts and has been to several seminars and got <br />this language from them. <br />Commissioner Scurlock asked if the 12% interest rate <br />mentioned in Item 7.5 on Page 5 is correct, and Attorney Vitunac <br />explained that the new law says that if the County doesn't pay <br />their bills within so many days of this date, they have to pay 12% <br />interest. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, the Board unanimously approved the <br />contract with Robert F.
