DEC <br />BOOK 78 PAGE 713 <br />TO: James Chandler <br />County Administrator <br />DEPARTMENT HEAD CONCURRENCE: <br />obert eating, <br />Community Developme <br />FROM: Roland DeBlois;'KICP <br />Chief, Environmental <br />DATE: December 8, 1989 <br />SUBJECT: <br />Director <br />Planning <br />INTERIM MANATEE PROTECTION <br />SPEED ZONE PLAN <br />It is requested that the data presented herein be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting onDecember19, 1989. <br />DESCRIPTION & CONDITIONS: <br />On October 24, 1989, the Florida Department of Natural Resources <br />(FDNR) made recommendations to the Governor and Cabinet=for <br />specific actions to protect the West Indian Manatee and to improve <br />waterway safety for the boating public. <br />Among FDNR's recommendations was a proposal for the development of <br />State rules to implement an interim 300' shorelinebuffer <br />slow -speed zone (approximately 7 m.p.h.) in State waters within 13 <br />key manatee protection counties, which includes Indian River <br />County. Rather than approve the referenced recommendation`°as is," <br />the Governor and Cabinet voted to allow counties"to select from <br />three alternatives: <br />1) A 300' -wide shoreline buffer slow -speed zone (not <br />including marked navigation channels); <br />2) A maximum 30 m.p.h. speed limit within marked channels, <br />and a 20 m.p.h. speed limit in other county waters; or' <br />3) Locally -developed site specific ordinances designating <br />speed zones based on local characteristics and needs. <br />Moreover, the Governor and Cabinet gave counties 60 days or until <br />°December 26, 1989 to select among the alternatives, or the State <br />would choose one of the first two alternatives to be implemented <br />-14a:in the county. If the county selects alternative 3, to develop <br />',W, --,,site-specific regulations, a "conceptual" manatee speed zone plan <br />';:must be submitted by the December deadline. <br />Following is a summary of important dates set forth by the State <br />that pertain to Indian River County: <br />December 26, 1989: Deadline for the County to select an interim <br />manatee protection alternative; "conceptual" <br />plan. <br />February 1990: <br />May 1990: <br />County finalization of interim manatee <br />protection plan, to be forwarded to the State <br />for approval and inclusion in State rules. <br />State adoption of rules, including local <br />interim manatee protection plans. <br />72 <br />
