F, <br />N 2 1990 <br />BOOK <br />TRAFFIC IMPACT FEES - FELLSMERE <br />The Board reviewed the following memo dated 12/27/89: <br />TO: Board of County Commissioners DATE: December 27, 1989 FILE: <br />SUBJECT: <br />JCh�� ndler G�1� <br />FROM <br />/JI:E. a <br />County Administrator REFERENCES: <br />As you are aware, Fellsmere stopped collecting traffic impact fees in 1987. <br />Several months ago, we initiated discussions with Fellsmere's mayor requesting <br />that the city resume collection of the fee. The Public Works Director and I <br />attended a workshop in October to present the request and answer questions <br />concerning the program. Subsequently, the matter was deferred at the <br />November meeting. At the December meeting they voted to not re -institute <br />the program. <br />The Traffic Impact Fee Program provides a vital revenue- source to meet the <br />required countywide expansion of arterial and collector roads resulting from <br />growth. In my opinion, the current program is a realistic and equitable <br />means of addressing these needs. If it is to continue as a viable program, I <br />believe all jurisdictions must participate. As a _result, I feel it is in the <br />County's best interest to pursue all avenues, including legal action if <br />necessary, to restore the program. <br />Administrator Chandler felt that they have gone as far as <br />possible with this on a staff level, and it would be his <br />recommendation to pursue legal action if necessary to restore the <br />program. <br />Commissioner Scurlock felt it would set a precedent not to <br />pursue having all the municipalities participate. He believed, <br />however, that there is a problem in what the various <br />municipalities understand about what the impact fees can be used <br />for. He emphasized that impact fees cannot be used to make up <br />for the past; they have to be used very specifically for new <br />growth. <br />38 <br />M <br />
