Corrective Resolution of Abandonment <br />The Board reviewed the following memo dated 1/17/90: <br />TO: The Board of County Commissioners <br />FROM: William G. Collins II - Assistant County Attorney <br />DATE: January 17, 1990 <br />SUBJECT: Corrective Resolution of Abandonment <br />On August 8, 1989 the Board of County Commissioners adopted <br />a resolution abandoning a portion of 92nd Court and 21st <br />Street. The Resolution of Abandonment was recorded and <br />transmitted to the Property Appraiser. The Property <br />Appraiser notified this office of an incorrect call in the <br />legal description of,..,the property being abandoned. In the <br />process of drafting the corrective resolution, I noticed <br />that In the close of paragraph 1 of Resolution No. 89-79, <br />the entire right-of-way was retained as an easement. In <br />other words, the attempted abandonment was ineffective. <br />According to the agenda item prepared for the Board, it was <br />the intention of the County staff to retain the entire <br />right-of-way as a drainage and utility easement. The <br />Corrective Resolution has been redrafted to correct this <br />oversight. <br />RECOMMENDATION <br />Adopt the Corrective Resolution to Resolution No. 89-79 <br />abandoning a portion of 92nd Court and 21st Street. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wheeler, the Board unanimously adopted <br />Resolution 90-19, correcting Resolution 89-79, <br />providing for the closing, abandonment, and vacation of <br />a portion of 92nd Court and 21st Street. <br />9 <br />
