DEMOLITION OF UNSAFE STRUCTURE - 1925 38TH LANE <br />The Board reviewed the following memo dated 1/24/90: <br />TO: James E. Keatin , A <br />Director, Community evelopment Department <br />DATE: January 24, 1990 <br />SUBJECT: Demolition of Unsafe Structure <br />1925 38th Lane <br />FROM: Ester L. Rymer, Direct <br />Building Division <br />It is requested that the information herein presented be given formal <br />consideration by the Board of County Commissioners at the meeting of <br />February 6, 1990. <br />DESCRIPTION AND CONDITIONS: <br />The above referenced structure (Parcel # 26-32-39-00010-0040-00056.0) <br />is considered unsafe as defined in Indian River County Code of Laws <br />and Ordinances, Chapter 4, Article II, Section 4-16. <br />It is the opinion of the Building Inspector and the Building Official <br />that said structure is beyond practical repair and is considered a <br />public nuisance; therefore, the structure has been condemned. <br />An attempt was made to notify the owner by certified mail, but the <br />address of record is no longer valid, and the forwarding order with <br />the Post Office has expired. A Public Notice was placed in the Vero <br />Beach Press Journal on January 13th and 18th, 1990, but to date there <br />has been no response. Our research indicates that the taxes have not <br />been paid on this property for 1986, 1987, 1988, and the 1989 taxes <br />have not been paid as of January 24th. <br />:ALTERNATIVES AND ANALYSIS: <br />^Y�N-i+;"+The Indian River County Code, Chapter 4, Article II, Section 4-21, <br />ives the Board of County Commissioners the authority to cause such a <br />i'"L�•'Y'building or structure or portion thereof to be demolished, secured, <br />or to remain vacant. Chapter 4, Article II, Section 4-22 <br />ives the Board of County <br />Commissioners the authority to remove the <br />.S{ 7'w ,,structure as stated in 4-21, and cause a lien to be filed of • record <br />a)tz..**•,.,for the costs of removal against the owner of the building. <br />CONCLUSION AND RECOMMENDATIONS: <br />Staff recommends the Board of County Commissioners declare said <br />structure a nuisance, and order the building to be demolished by the <br />County Road and Bridge Department. <br />After removal, in accordance with referenced Ordinance of Indian <br />River County, staff recommends a lien be filed of record for the <br />costs of removal against the owner or person in charge of said prop- <br />erty. <br />BO9 <br />OP( � <br />64 <br />FEB 6 1990 <br />
