Schlitt <br />505 66th Avenue <br />Vero Beach, F1. 32968 <br />January 17, 1990 <br />BOOK - l q <br />9 FADE �e <br />On December 29, 1989, my wife and I purchased a lot in <br />Pinetree Park, Lot 14 Block J Unit 2. The dimensions <br />were 75' x 100'. I bought a print to fit the lot and <br />had it surveyed. I then submitted my plans to the <br />Indian River County Building Department. <br />When I inquired about the septic tank, they asked me to <br />have the lot cleared for the perk test, so I did. On <br />my septic tank and well <br />determined by the heighth of <br />on January 5, 1990, and set <br />and compaction test to <br />January 3, 1990 I picked up <br />permits. Since the fill is <br />my tank, I ordered my fill <br />up for grading, compacting, <br />follow. <br />On January 11,,1990 I was informed by Environmental 4 <br />Health that someone had made a mistake when they t <br />released my permits, and to stop construction. I r <br />talked to Stan Bowling who informed me that the County_ <br />needed 65 feet of my property to allow for the right o\ <br />way for the Thoroughfare Plan. He mentioned that the <br />County would probably have to buy the whole lot. I <br />proceeded to inform Stan that there were several houses <br />built within thes right of way in the past 24 months <br />including one under construction at this present time. <br />I contacted Jim Davis on the matter. He informed .me he <br />was not taking the 65 feet needed, but 25 feet without <br />compensation. When I explained to him that even if e <br />just took 25 feet the.property would be unbuildable. <br />He mentioned a variance to—allow—me=-to-=pu-t--my--septic------ <br />.tank and drain field in the 25 feet. It makes no sense <br />that I would be allowed to use the 25 feet in a variance <br />for my septic tank and drain field if my entire property <br />has to be bought and destroyed along with the other 15 or <br />so houses that are my neighbors on Fourth Street in order <br />to,accomodate the Thoroughfare Plan. <br />I met with Jim Davis on January 14, 1990 and explained <br />to him how long it has taken myAand I to come to this <br />Close to owning our own home, -and how badly this will affect <br />our finacial planning and progress. Although Mr. Davis <br />has been as helpful as possible under the circumstances, <br />I will not settle for less than full compensation of my <br />purchase price and all expenses to this point, or <br />permission to build on the property as I originally <br />planned.
