Legal_Status of the Comprehensive Plan <br />Upon adoption of the 1990 Indian River County Comprehensive <br />Plan, (pursuant to Florida Statutes 163.3194, all development <br />undertaken by, and all actions taken in regard to development <br />orders by Indian River County government agencies shall be consis- <br />tent with the adopted comprehensive plan. All land development <br />regulations enacted or amended shall be consistent with the <br />adopted comprehensive plan. <br />By September 1, 1990, the county shall adopt new and/or <br />amended land development regulations consistent with the adopted <br />comprehensive plan. During the interim period when the provisions <br />of the 1990 Comprehensive Plan and the existing land development <br />regulations are inconsistent, or if there are not adequate land <br />development regulations to implement the intent of the comprehen- <br />sive plan, the adopted 1990 Comprehensive Plan shall govern any <br />action taken in regard to an application for a development order. <br />SECTION 4. CODIFICATION <br />_The provisions of this ordinance shall be incorporated into <br />the Copnty Code and the word "ordinance" may be changed to rrsec- <br />n "article", articlenor other appropriate word, and the sections of <br />this o'dinance may be renumbered or relettered to accomplish such <br />intent ons. <br />SECTION 5. REPEAL OF CONFLICTING_ PROVISIONS <br />A1 previous ordinances, resolutions, or motions of the Board <br />of Cou ty Commissioners of Indian River County, Florida which <br />conflict with the provisions of this ordinance are hereby repealed <br />to the extent of such conflict. All Special Acts of the legisla- <br />ture a plying only to the unincorporated_._porton__._of Indian River <br />County and which conflict with the provisions of this ordinance <br />are hereby repealed to the extent of such conflict. <br />S CTION 6. Severability <br />It is declared to be the intent of the Board of County <br />Commis ioners that if any provision of this Ordinance and there- <br />fore, the Indian River County Comprehensive Plan is for any reason <br />finally held invalid or unconstitutional by any court of competent <br />jurisdiction, such provision shall be deemed a separate, distinct <br />and independent provision and such holding shall' not affect the <br />validity of the remaining provisions. <br />SECTION 7.
