right-of-way for U.S. #1 west of the centerline of U.S. #1 as <br />recommended by the Public Works Director. <br />With the stated U.S. #1 right-of-way and easement reservation <br />conditions, all right-of-way abandonment criteria and policies are <br />satisfied. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to the subject <br />portion of 4th Place and that the Chairman of the Board of County <br />Commissioners be authorized to execute the attached resolution <br />(Attachment #4), which contains the following conditions: <br />1. That the east 50' of the described subject right-of-way be <br />retained by the County for U.S. #1 right-of-way. <br />2. That an above ground utility easement be retained over the <br />entire area abandoned, and a 20' wide drainage and utilities <br />easement be retained, centered over the abandoned <br />right-of-way. <br />Commissioner Bowman asked if we would have a problem if the <br />property was sold, and Stan Boling, Chief of Current Development, <br />explained that this really affects two properties. The <br />right-of-way is between two properties, and everyone has access. <br />Chairman Eggert opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. There being none, she <br />closed the Public Hearing. <br />ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Scurlock, the Board unanimously adopted <br />Resolution 90-22, providing for the closing, <br />abandonment, and vacation of a portion of 4th Place. <br />10 <br />BOOK <br />
