This will not be the type of case where <br />a neighbor could call up and complain and based on the complaint, <br />the dog would be determined to be vicious. There has to be a <br />thorough investigation. The animal control officers will have to <br />document their findings, which will be reviewed by the County <br />Attorney's Office, and of course, we will be looking at the <br />possibility of at least two and possibly 3 appeals of the deter- <br />mination before we go forward with labelling a dog as vicious. <br />Staff is going to make sure that we have basis for this deter- <br />mination. <br />Commissioner Scurlock asked if we have anyone on our staff <br />who is a certified breeder or has professional training, and <br />Attorney Brennan advised that our animal control officers are <br />attending seminars and training courses on dog behavior. <br />Chairman Eggert understood then that a dog such as <br />Commissioner Scurlock's could not be declared a vicious dog, and <br />Attorney Brennan advised that particular incident would have an <br />exempt circumstance. She felt the proposed ordinance is very <br />workable because you really have to look at the totality of the <br />circumstances. It is not that different from our current <br />ordinance except that our current ordinance has a 2 -tiered review <br />system. At the first incident, the dog would be declared <br />dangerous, and then if there is another incident within 18 <br />months, the dog would be declared vicious and there would be_ <br />additional ownership responsibilities.
