ORDINANCE: <br />Section 1 - Vicious Dog -- <br />Delete (a), Definition of a. unprovoked? <br />b. attitude of attack (ears back?) 0,,2 c c/,vr <br />° c. vicious/terrorizing (circling?) <br />Delete (b), Definition of a. attack (jumping at?) <br />b. unprovoked? <br />(c) - Without provocation? Who will determine? ?"-Po� wf1951- <br />(d) - Just because a dog is used for fighting other dogs, may or may not necessarily mean <br />he is vicious. There are already laws prohibiting dog fighting. If it can be <br />proven the dog is being used in dog fights, does not the State of Florida have <br />jurisdiction to prosecute the owners) or keeper(s) of the dog? If so, this section <br />would be negated by the State's right. Therefore, recommend to delete. <br />Section 2 (7) - Does the State of Florida have a range law which makes the owner(s) of <br />livestock responsible for damage to property if they are outside a <br />fenced enclosure? <br />Section 2 (8) - Not enough personnel to enforce - teasing or molesting needs to be <br />clearly defined - whats constitutes teasing and molesting? <br />Section 2 (9) - Crate/cage is not the only safety device available. There are <br />alternatives which are less expensive. Needs to be broadened. �o <br />Section 3 (a) What are the credentials, with reference to dog behav� 8 d s ch�6 SYU <br />of the officers and the Department of Emergency Services Director whogy� <br />will be empowered to make the determination of vicious? <br />Section 3 (b) Define teasing, tormenting, abusing and assalting as it will be applied <br />to inter- and intra -species activity. <br />Section 3, 6, d If the vicious ... and all previously mandated responsibilities of <br />ownership of said vicious dog, as set forth in this Ordinance, shall <br />automatically transfer to the new owner(s) or keeper(s). <br />Section 3 (d) The provisions of this section shall not apply to certified canine law <br />enforcement dogs during their performance of law enforcement work for <br />which they are certified, which are owned by any law enforcement <br />department * Said dogs shall be subject to the same regulations and <br />review as a law enforcement officer who fires his gun in the line of <br />duty. When said dogs are not on duty .or are not in performance of law <br />enforcement work for which they are certified, all provision as set <br />forth in this Ordinance shall apply. <br />* Delete: or any law enforcement officer (cite Sebastian) <br />Section 3 (e) Why kill the dog - Arrest or fine the owner(s) or keeper(s) - The dog <br />cannot be held responsible for non-compliance of its owner(s) or <br />keeper(s). <br />Section _3 (f) 1. Define "unprovoked" <br />2. Define "impound" - In-home confinement or county confinement? <br />If in-home, will routine inspections be <br />made to determine compliance? <br />Health Department incident. <br />2. 120 hours (5 days) should be changed to 240 hours (10 days). If <br />dog is euthanized before 10 days, county will be required to incur <br />expenses of testing dog for rabies viral infection. <br />Dr. Ian Dunbar - Biting is a behavior. <br />Why a dog bites has to do with the dog's temperament. <br />It is normal for a dog to bite. When a dog is uj(pset, he is not going <br />to send you a poison pen letter or give you -----, or anything like <br />that. He is just going to bite you. People must realize that biting is <br />a normal behavior for all dogs and the onus is on the owner to train the <br />dog to prevent it from biting. <br />All dogs are potential biters. <br />29a <br />
