Loeper �/tL <br />Staff Planner <br />DATE: February 19, 1990 <br />SUBJECT: TY TARBY REQUEST TO AMEND THE COMPREHENSIVE PLAN AND <br />REZONE 156 ACRES <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of February 27, 1990. <br />- DESCRIPTION AND CONDITIONS: <br />Ty Tarby, Trustee, has submitted a request to amend the <br />Comprehensive Plan and rezone property. The subject property is <br />located on the north side of S.R. 60 between 58th and 66th <br />Avenues. The request includes 156 acres of a 214 acre parcel. <br />The request entails changing the existing land use from M-1, <br />Medium -Density Residential (up to 8 units per acre) to General <br />Commercial Node, and rezoning the property from A-1, Agricultural <br />District (1 unit/5 acres); RS -6, Single -Family Residential <br />District (6 units/acre); and RM -6, Multi -Family Residential (6 <br />units/acre) to CG, General Commercial District. This request is <br />considered an expansion of the State Road 60 and Kings Highway <br />Commercial Node from 160 acres to 316 acres. <br />The purpose of this request is to secure the necessary land use <br />designation and zoning for a regional shopping center. The <br />Edward J. DeBartolo Corp., is proposing to construct a 707,000 <br />square foot regional mall and 440,000 square feet of peripheral <br />commercial space. The entire project is to be reviewed as a <br />Development of Regional Impact (DRI). <br />On September 1, 1989, Indian River County transmitted a <br />substantially revised comprehensive plan to the State Department <br />of Community Affairs for review as required by the State Growth <br />Management Act. <br />On February 13, 1990, the Board of County Commissioners adopted <br />the new comprehensive plan. The adopted portion of the plan <br />includes the Goals, Objectives and Policies of the various plan <br />elements, a series of maps including the future land use map, and <br />the narrative of the Capital Improvements Element. <br />The remaining text constituting over 1500 pages was not adopted as <br />part of the plan; however, this support data and analysis provide <br />the basis for the plan. The adopted plan has been submitted to <br />the state for compliance review as mandated by the State Growth <br />Management Act. Regardless of the outcome of the compliance <br />review, the plan enjoys the force of law and, as such, all <br />development in the unincorporated portions of the county must <br />adhere to the provisions of the plan. <br />40 <br />
