Chandler <br />County Administrator <br />DIVISION HEAD CONCURRENCE: <br />c <br />Rober M. ea.ing, AI <br />Community DeJvglopment irector <br />FROM: Stan Boling, AICP <br />Planning.Director <br />DATE: February 23, 1990 <br />SUBJECT: REQUEST TO VACATE THE SUNSHINE QUALITY HOMES UNIT 2 PLAT <br />i <br />I <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of March 6, 1990 <br />DESCRIPTION AND CONDITIONS: <br />Architect John Dean, on behalf of Frank and Concetta Liggieri and <br />Paul Liggieri, owners, is requesting that the Board of County <br />Commissioners vacate the "Sunshine Quality Homes Unit -2" subdivi- <br />sion as recorded in Plat Book 5, Page 63, public records of Indian <br />River County, Florida in 1958. The vacation request covers 19 <br />vacant lots, a park tract, and several "paper street" segments. <br />This request was originally scheduled to be considered at the <br />December 19, 1989 Board of County Commissioners meeting. However, <br />the request was withdrawn by the applicants to allow time for the <br />purchase of the subdivision park tract from the county. The <br />applicant has now successfully bid for the park tract and is now <br />finalizing the purchase. <br />The subject Unit 2 plat is an "extension" of the Unit 1 existing <br />single family subdivision which lies between Unit 2 and 6th <br />Avenue. None of the platted Unit 2 roadways provide access to <br />adjacent properties. However, some public utilities improvements <br />are located within some of the platted rights-of-way (said <br />rights-of-way are dedicated to the public). <br />The subdivision also includes a park tract which measures 97' X <br />59' dedicated to the county via the plat. Except for the park <br />tract, all other portions of the subdivision are zoned RM -10, <br />Residential Multiple -Family up to 10 units per acre. The park <br />tract is currently zoned CG, General Commercial, and, as previous- <br />ly indicated, is being purchased by the applicants. Upon purchas- <br />ing the tract, the applicants will own and control all portions of <br />the entire subdivision. <br />The applicants are requesting the plat vacation so that the entire <br />subdivision may be unified and developed as one project without <br />the constraints of the existing right-of-way and lot layout. <br />ANALYSIS: <br />- State Requirements <br />According to Chapter 177.101 of the Florida Statutes, the Board of <br />County Commissioners has the authority to vacate plats in whole or <br />in part, returning all or portions of the property into acreage. <br />The vacation is accomplished by resolution of the Board.
