MAR 13 1990 <br />�ooK 1 fAGL <br />use Florida Highway Patrol or Indian River County Sheriff Department <br />personnel while on site to assist normal flow of traffic. Paramount is herein <br />specifically given permission to close County Road 512 for a maximum of four <br />hours on a date which will be specified on the telephone and in writing to the <br />County at least two weeks prior to date -of closure. Paramount also agrees to <br />allow all emergency vehicles immediate and unqualified access through the <br />portion of road which Paramount will be' using regardless of the state of <br />Paramount's progress at the time. Paramount will abort the "take" In <br />progress and resume filming after the emergency vehicle has passed. <br />Paramount will provide signage which will be posted stating date of closure <br />two weeks prior to date of closure. Paramount will be allowed to close the <br />road the following day if weather or technical difficulties .preclude filming on <br />the specified date. Paramount Pictures is also allowed to use the County <br />Park area known as Middleton's Fish Camp as an equipment area and launch <br />area while Paramount films on the lake. (Anticipated two days on lake, <br />balance in marsh) . <br />Paramount shall inform County Administrator's office of final schedule and <br />shall keep County Administrator's office posted daily via telephone of the <br />progress in filming. <br />However, if because of illness of actors, director or other essential artists <br />and crew, or weather conditions or any other occurrence beyond Paramount's <br />control, preventing Paramount from starting work on the date designated <br />above, or in the event of damage or imperfect film or equipment, Paramount <br />shall have the right to use the premises at a later date to be mutually agreed <br />upon, without additional charge. <br />This is In connection with the motion picture photoplay tentatively entitled <br />"ARRIVE ALIVE",' and includes the right to re -use the photography in <br />connection with other motion picture photoplays as Paramount, its successors, <br />assigns and licensees shall elect in connection with the exhibition, advertising <br />and exploitation there in any manner whatsoever and at any time in any part <br />of the' world. <br />Paramount agrees to indemnify and hold County harmless for every and all <br />claims that may arise from Paramount's use of County property, including <br />court costs. and attorney's fees, and including use by permittees of <br />Paramount. Paramount also agrees to repair any damage that it causes to the <br />premises and restore the premises as originally found or better at its own <br />expense and labor except for reasonable wear and tear. <br />The County acknowledges that in photographing the premises, Paramount is <br />not in any way depicting or portraying the County in said motion picture <br />photoplay, either directly or indirectly. The County will not assert or <br />maintain against Paramount any claim of any kind or nature whatsoever, <br />including, but not limited to, those based upon invasion of privacy or other <br />civil rights, defamation, libel or slander, in connection with the exercise of <br />the permission or rights herein granted. <br />The County represents that it is the owner and/or authorized representative <br />of said premises, and that it has the authority to grant Paramount permission <br />and rights herein granted, and that no one else's permission is required. <br />Paramount's letter dateckMarch 9, 1990 to Randy Dowling, Assistant to the <br />County Administrator, is erein made part of this agreement. <br />Dated this __5,3�� day of�� , 1990. <br />AGREE. <br />By <br />Pictures Corporation <br />Sanchez-Arafi o <br />.Unit Location Manager <br />and �\, (1�*Uo <br />C.
