Twore <br />Staff Planner <br />DATE: March 5, 1990 <br />SUBJECT: PLAT VACATION REQUEST FOR A PORTION OF <br />CAMBRIDGE PARK SUBDIVISION <br />It is requested that the data herein be given formal consideration <br />by the Board of County Commissioners at its regular meeting of <br />March 13, 1990. <br />DESCRIPTION AND CONDITIONS: <br />Paul Domico, on behalf of William C. Brown Company, Publishers <br />(Incorporated), is requesting that the Board of County Commission- <br />ers vacate a portion of the Cambridge Park Subdivision as recorded <br />in Plat Book 12, Page 98, Public Records of Indian River County, <br />Florida. The portion of the plat to be vacated (see Attachment <br />#3) includes lots 28-31, all of which are owned by William C. <br />Brown Company, Publishers (Incorporated). The subject property is <br />located within the Cambridge Park Subdivision, on the east side of <br />80th Court, immediately south of 18th Place (see Attachment #2). <br />The portion of the plat to be vacated does not affect any public <br />or private facilities or access rights other than what relates to <br />the lots being vacated. The owner{ William C. Brown, Publishers <br />(Incorporated), has decided to replat the vacated area in order to <br />provide a recreation tract for a future clubhouse. This plat <br />vacation will be followed by a new final plat for the affected <br />area. <br />ANALYSIS: <br />According to Chapter 177.101 of the Florida Statutes, the Board of <br />County Commissioners has the authority to vacate plats in whole or <br />in part, returning all or portions of the property into acreage. <br />The vacation is accomplished by resolution of the Board. Before <br />the resolution can be approved by the County Commission~ <br />1. It must be shown that the persons making application for <br />the vacation own fee simple title to that part of the <br />tract covered by the plat•sought to be vacated. <br />2. It must be shown that the vacation will not affect the <br />ownership or right of convenient access of persons <br />owning other parts of the subdivision. <br />30 <br />
