Mr. Levy answered that he didn't know about Lot #14 until he <br />started checking into the $9800 lien. He wished to reiterate <br />that when Mr. Pinto showed them the property they purchased, he <br />opened up the gate and said, "this is the property you bought." <br />Utilities Director Terry Pinto wished to state for the <br />record that he never took Mr. Levy to see the subject property. <br />Secondly, the County did not pay $100,000 for a lot. We paid <br />$100,000 for the entire utility system, and after it was <br />determined that the lot had no value to our facility, it was <br />declared surplus property. We put the lot up for sale through <br />the normal surplus property process and sold it to Mr. Levy and <br />his partners sight unseen for $4,000. Sometime later, Joe Baird, <br />Assistant Director of Utilities at that time, took Mr. Levy out <br />to see the property and Mr. Levy was'quite surprised to find that <br />there was an abandoned water tank that would have to be removed <br />at their expense. Director Pinto emphasized that we had no <br />responsibility to tell Mr. Levy which lot was which. He had the <br />legal description, and it was his responsibility to get the <br />property surveyed. So, it was a case of let the buyer beware. <br />In fact, we had another piece of property off of Oslo Road that <br />was up for sale and that needed to be completely cleared. <br />Commissioner Bird asked why the County didn't have it <br />surveyed at the time we bought the property for the utility <br />system, and Director Pinto advised that we bought the utility <br />prior to his coming to the County, but he understood that it was <br />a very complicated matter and that former County Attorney Joe <br />Collins handled -that entire purchase for the County. <br />Commissioner Wheeler asked if we have a survey of it now and <br />whether anyone knows for sure where the property lines are. <br />Chairman Eggert felt that if Lot #14 is partially within the <br />fenced -in area, the line for nuisance abatement should be split. <br />OMB Director Joe Baird confirmed that he took three <br />gentlemen out to see the property that they purchased sight <br />unseen simply because they asked him how to get there.
