,MAR 2 0 1990. <br />BOOK ��' <br />9 PAGE 640 <br />Commissioner Bird asked for further explanation of the <br />existing easement through the property. <br />Attorney Collins explained that when we sent out the <br />contract, we listed any easements that were on the property <br />because if land is not free and clear, the value might have to be <br />reduced by the value of that easement. We would have to allocate <br />the purchase price to the easement holder in part. That easement <br />runs to Indian River West, Inc., and since we just authorized <br />condemnation of their interest, we would be the successor of all <br />right, title and interest to that easement, we no longer really <br />require the release. <br />Commissioner Bird asked if there was an easement across <br />parcel #105 to get to parcels #106 and #107, and Attorney Collins <br />said there was not. Parcel #105 granted an easement to Parcel <br />#103 owned by Indian River West, Inc. but since we are condemning <br />that parcel, we don't have to worry about that easement anymore. <br />ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Bowman, the Board unanimously (4-0, <br />Commissioner Scurlock being absent) approved staff's <br />recommendation of Alternative #1 as set out in the <br />above memo. <br />Attorney Sechen wished to answer Commissioner Bird's <br />concerns about exhausting all opportunities to settle without <br />having to go to court. He advised that now that the Board has <br />authorized us to proceed with the eminent domain proceedings, we <br />would be contacting the property owners again to try and work out <br />something prior to the filing of the action if that is at all <br />possible. Sometimes it is possible to do it this way, and they <br />will try and do that. <br />Commissioner Bird asked the status of Parcels #108 and #110, <br />and Director Davis advised that those owners have filed for an <br />66 <br />� s � <br />
