RECOMMENDATION: <br />The Staff of the Department of utility Services recommends that the <br />Board of County Commissioners .approve the attached Agreement to <br />Furnish Economic and Financial Consulting Services to Indian River <br />County, and authorize execution of the Agreement. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously approved <br />the Agreement with CH2M Hill Southeast, Inc. to Furnish <br />Economic and Financial Consulting Services to Indian <br />River County, as recommended by staff. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />SCHEDULING OF A PUBLIC HEARING FOR CONSIDERATION OF COUNTY TO <br />RENOUNCE AND DISCLAIM ANY RIGHT OF THE COUNTY AND THE PUBLIC IN <br />AND TO A "PUBLIC STREET" IN SUN ACRES SUBDIVISION <br />The Board reviewed the following memo dated 3/26/90: <br />TO: The Board of County Commissioners <br />FROM; tJ�*illiam G. Collins II - Assistant County Attorney <br />DATE: March 26, 1990 <br />SUBJECT: Request to Set Public Hearing <br />For approximately a year, the County staff has been working <br />with David Albrecht, Esq. who represents Mr. Hudgins, the <br />owner of a lot in Sun Acres Subdivision, in an attempt to <br />clear up questions of title and the buildability of Mr. <br />Hudgins' lot. <br />There is currently a cloud on Mr. Hudgins' title because <br />property which is being used as his driveway and for access <br />to lith Place is shown in various public records as a public <br />road. This has come about because the original developer of <br />the Sun Acres Subdivision, Frank Zorc, quit -claimed the road <br />to "the public" in 1965. A deed to "the public" is <br />ineffective to pass title because there is no person capable <br />of accepting the grant. (For example, a quit -claim to the <br />Board of County Commissioners of Indian River County would <br />have been adequate.) The situation was further clouded when <br />a replat of the Sun Acres Subdivision attempted to dedicate <br />the same property as a private road.
