SUMMARY OF SPECIAL ACTS OF LOCAL APPLICATION <br /> FOR INDIAN RIVER COUNTY <br /> INDIAN RIVER COUNTY <br /> CH.21305(1941)—prohibits any person from taking or attempting to take fish with anything other <br /> than hook and line from within the channel of the Indian River in Indian River County or from within one <br /> hundred feet on each side of the channel. The act also prohibits the use, placement,or attempted use <br /> of any net,seine,or other device designed to take or attempt to take fish or capable of taking or <br /> attempting to take fish in the channel and within one.hundred feet of the sides of the channel. <br /> Comparison with general provisions: <br /> Chapter 21305 restricts more fishing gear in the channel of the Indian River than general <br /> provisions that govern Florida waters in general. Unlike chapter 21305,general provisions do <br /> not restrict the use of all nets. However,general provisions do limit what kinds of nets may be <br /> used and require nets of certain specifications. Also, article X,section 16 of the Flarida <br /> Constitution prohibits the use of gill nets or entangling nets in any Florida waters. <br /> Gear specifications and prohibited gear are covered extensively in chapter 688-4 of the Florida <br /> Administrative Code. Rule 688-4.0081(2)(a) prohibits the use or placement of any gill or <br /> entangling nets of any size in any State waters. Any net,other than a cast net, landing or dip <br /> net,jelly fish paired trawl,or calico scallop otter trawl with a mesh size greater than two inches <br /> stretched mesh is also prohibited. Id. R. 68B-4.0081(2)(d). Use and possession of longline gear is <br /> prohibited,except while in transit through state waters to fish from waters of another state or <br /> the Exclusive Economic Zone.Id. R. 6813-4.0087.Obstructing any river or other waterway by <br /> placing or setting any screen, net,seine, rack,wire or other device that impedes the free <br /> passage of fish is prohibited.Id. R. 68B-4.0083(4). In addition,chapter 6813-4 makes it unlawful <br /> for any person to use poisons,drugs, or other chemicals in state marine waters to harvest fish. <br /> Id. R. 6813-4.0083. <br /> CH.77-572—prohibits taking or attempting to take fish with anything other than hook and line, pole <br /> and line,rod and reel,or hand-thrown cast net from waters of the Indian River which are within one <br /> hundred feet of any bridge that traverses the Indian River in Indian River County or the Sebastian Inlet, <br /> or within one hundred feet of any canal or artificial waterway in Indian River County.The act also <br /> prohibits any person from throwing or attempting to throw a cast net from any bridge traversing the <br /> Indian River in Indian River County, excluding the Sebastian Inlet Bridge. <br /> Comparison with general provisions: <br /> As mentioned above in the chapter 21305 comparison with general provisions,fishing gear <br /> specifications and prohibited gear are extensively covered in chapter 6813-4 of the Florida <br /> Administrative Code. General provisions apply to all Florida waters, regardless of proximity to <br /> bridges, except in regard to spearfishing and attachment of nets. Spearfishing is prohibited <br /> within 100 yards of all commercial or public fishing piers and within 100 yards of any portion of <br /> 157 <br />
