S. l,(4,zS <br />Environmental Control Offic r <br />SUBJECT: Report of Activities for <br />Fourth Quarter 2014 (July 1- September 30, 2014) <br />The following is a summary of enforcement activities conducted by the Environmental <br />Control Office during the above quarter: <br />1. At all times pertinent to this action, Respondents, Gaddis Capital Corporation, have <br />owned real property located at 4410 45th Street, Vero Beach, Florida (Subject <br />Property). On or about September 9, 2013, Petitioner conducted an inspection of <br />the Subject Property and found a sanitary nuisance presence in that the property <br />contained an abundance of auto and truck tires as well as other debris that were <br />facilitating the breeding of disease carrying mosquitoes. The Respondents were <br />directed to take all measures necessary to remove and abate all mosquito breeding <br />areas upon the Subject Property including to provide proper documentation for the <br />disposal of potentially regulated debris, such as tires, as well as any and all <br />regulated debris discovered. <br />Immediately prior to the Environmental Control Hearing Board (ECHB) meeting <br />dated December 5, 2013, the petitioner re -inspected the Subject Property and <br />determined that the referenced violations had not been corrected. The Board <br />directed the Respondents to clean-up and imposed a fine which amounted to <br />$42,500 if the Subject Property was not cleaned -up within 60 days. At the April 3, <br />2014, the Board requested an update on the Subject Property. However, the <br />Subject Property Representatives had not been noticed nor was the matter on the <br />agenda. Therefore, at the Board's request the matter was placed on the agenda as <br />a re -hearing on June 5, 2014. From the time of the December 5, 2013, hearing to <br />the time of the re -hearing June 5, 2014, despite additional pressure from Code <br />Enforcement Board, as well as the assistance of Mr. Joseph Paladin, an <br />independent consultant retained owner of the Subject Property, minimal clean-up of <br />the tires had occurred.
