DeBraal, Deputy County Attorney�� <br />DATE: November 12, 2014 <br />SUBJECT: Extension of the License Agreement for Ryall Tract <br />ATTORNEY <br />The Ryall Property was purchased by the County in 2006 with help from the Indian River <br />Land Trust. The 10.1 acre Ryall Tract is located at 7780 85th Street and is improved with a <br />single family house and detached shed. The house was renovated in 2012. The County <br />entered into a license agreement with William Luther, a Sheriffs Deputy with the Indian <br />River County Sheriffs Office whereby Mr. Luther could reside on the property and provide <br />a law enforcement presence for security reasons and in exchange, Mr. Luther would <br />maintain the house and property, keep approximately 1 acre mowed on the Ryall Tract and <br />a small strip on the adjacent former Shadowbrook Estates Tract. <br />Mr. Luther desires to continue under the License Agreement by extending it for two years <br />from the date of expiration of the initial License Agreement, under the same terms and <br />conditions. The License Agreement has been a mutual benefit to the parties and the <br />attached Renewal and Extension of License Agreement will extend the License Agreement <br />until June 2016. Staff has no objection to the extension of the License Agreement. As the <br />Ryall parcel was purchased in part with funds from the Florida Communities Trust, the trust <br />must agree to the Extension. <br />Funding. There is no direct funding impacted by this Renewal and Extension of License <br />Agreement. <br />Recommendation. Staff recommends that the Board authorize the Chairman to sign the <br />attached Renewal and Extension of License Agreement between Indian River County and <br />William Luther to provide for the extension of the Agreement until June 2016. <br />Please contact me should you have any questions concerning this matter. <br />�l 3V <br />296 <br />
