CC 11.18.14 <br />Ofce of <br />INDIAN RIVER COUNTY <br />ATTORNEY <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney f <br />DATE: November 12, 2014 <br />SUBJECT: All Aboard Florida Draft Environmental Impact Statement and Future Actions <br />BACKGROUND <br />Draft Environmental Impact Statement <br />140- The proposed All Aboard Florida passenger rail project Draft Environmental Impact Statement (DEIS) <br />was released on Friday, September 19, 2014. At the October 21, 2014 Board of County Commissioners <br />("Board") meeting, the County Attorney's Office presented a preliminary assessment of the DEIS. The <br />preliminary assessment of the DEIS was that the DEIS was merely a superficial review of the alternatives <br />and the impacts and lacked a detailed analysis of the various categories of areas of study to be addressed <br />in an Environmental Impact Statement. The County Attorney's Office is now presenting a full detailed set <br />of comments to the Board for approval to be submitted to the Federal Railroad Administration. The <br />comments on the DEIS are due to the Federal Railroad Administration by December 3, 2014. <br />The County Attorney's Office has coordinated the review of the DEIS with outside counsel, Kevin Healy, <br />with the law firm of Bryan Cave LLP, outside consultant Jill Grimaldi, Principal Scientist, and her firm <br />CDM Smith, and the Community Development Department and the Public Works Department.
