Mora, P.E., <br />Public Works Director <br />CONSENT AGENDA <br />SUBJECT: Providence Pointe Vero Beach LLC <br />Developer Agreements for Right -of -Way Dedications and <br />Funded Roadway and Drainage Improvements <br />DATE: October 30, 2014 <br />loper- <br />DESCRIPTION AND CONDITIONS <br />Providence Pointe Vero Beach LLC plans to build a mixed-use residential/commercial <br />development on a 157 -acre site located on the west side of 58th Avenue between 49th <br />Street and 53rd Street (see Exhibit "A"). <br />To accommodate the Providence Pointe project, various transportation improvemen s must <br />'"aw be made to accommodate future traffic associated with the new development. Right-of- <br />way dedications and roadway/intersection widening projects must be funded and/or <br />accomplished by the developer along 53rd Street, 58th Avenue and 49th Street, in <br />accordance with the conditions listed in the rezoning/PD plan approved by the Board in <br />August, 2013. <br />The provisions within the attached two agreements, listed below, have been revie ed and <br />approved by staff. <br />AGREEMENT #1 (attached): DEVELOPER'S AGREEMENT BETWEEN INDIAN RIVER <br />COUNTY AND PROVIDENCE POINTE VERO BEACH LLC FOR OFF-SITE T AFFIC <br />IMPROVEMENTS AND RIGHT-OF-WAY DEDICATION <br />AGREEMENT #2 (attached): AGREEMENT FOR THE DEDICATION OF RIGHT <br />ALTERNATIVES AND ANALYSIS <br />The alternatives presented are: <br />Alternative No. 1 <br />Approve Developer AGREEMENT #1 and Developer AGREEMENT #2 <br />Alternative No. 2 <br />Deny Approval <br />-WAY <br />56 <br />
