BOAT CLUB ISLAND (SPOIL ISLAND IR -25) <br />AGREEMENT FOR IMPROVEMENT AND MAINTENANCE OF BOAT <br />CLUB ISLAND <br />THIS AGREEMENT is entered into this llth day of June 2013, byand <br />between Indian River County, a political subdivision of the State of Florida, 1801 27h treet, <br />Vero Beach, FL 32960 ("County") and Grand Harbor Community Association, Inc., a Florida <br />non-profit corporation, 4755 South Harbor Drive, Vero Beach, FL 32967 ("Association"). <br />WHEREAS, on or about March 29, 2010, the County entered into a Sovereignty <br />Submerged Lands Lease ("State Lease") with the Board of Trustees of the Internal Improvement <br />Trust Fund of the State of Florida, for use of the southern portion of Spoil Island IR -25, known <br />locally as "Boat Club Island" ("South 1R-25"), a copy of which is attached hereto as Exhibit A; <br />and <br />WHEREAS, the Association has offered to enter into an arrangement with the County in <br />which the County and the Association will share the cost of certain improvements on South IR - <br />25, and the Association will provide volunteer services to clean-up and maintain South IR -25, all <br />as set forth more fully herein; and <br />WHEREAS, the County desires to accept the Association's offer, recognizing that the <br />arrangement will result in a public — private cooperative effort which will benefit, and provide <br />increased recreational opportunities for, the residents of and visitors to Indian River County, <br />NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency <br />of which is hereby acknowledged, the parties hereby agree as follows: <br />1 • RECITALS. The above recitals are true and correct, and are incorporated herein. <br />2. DOCKS. The parties shall confer and develop a plan to repair the southernmost <br />dock on South IR 25 to a condition which is suitable for public use, and to remove the remaining <br />two docks which are currently in a state of disrepair. Upon development pment of a mutually <br />acceptable plan, and receipt of a mutuals <br />Cour shall y acceptable proposal for construction services, the <br />ty(a) apply for a grant from the Florida inland Navigation District ("FIND"), which <br />grant amount is estimated to be in the amount of $7,500, and (b) apply for any permits (other <br />than a building permit) which may be necessary to implement the plan. Upon receipt of the <br />FIND grant and required permits, the County shall enter into an agreement for construction <br />services with ,a qualified contractor.
