2214 LAWS OF FLORIDA <br /> Section 101. The said City of Vero Beach shall not be liable for <br /> personal injuries due to defective condition of or obstruction in its <br /> streets, public thoroughfares, public buildings, or parks, nor for the <br /> misfeasance,nonfeasance or malfeasance of its officers or employees; <br /> nor for any act of any of its employees, whereby through the act <br /> of such employees any injury or damage may be done or caused to <br /> the person or property of another. <br /> Section 102. That in addition to'the powers hereinbefore enu- <br /> merated, said City and its officers and employees shall have all the <br /> powers and perform all the duties conferred or imposed upon cities <br /> and towns of the State of Florida and officers and employees of such <br /> cities and towns by the general laws of Florida now in force or <br /> hereafter to be enacted providing for the government of cities and <br /> towns, not inconsistent with the provisions of this Act; and in all <br /> matters of procedure and conduct for the exercise and performance <br /> of such powers and duties, the general law of the State relative to <br /> municipalities shall govern, except where otherwise especially pro- <br /> vided by this Act, and no special power herein granted shall be con- <br /> strued to abridge any general power given hereunder or under the <br /> general laws of the State of Florida. <br /> Section 103. The City Planning and Zoning Commission of the <br /> City of Vero Beach, Florida, as heretofore created by ordinance of <br /> the City of Vero Beach abolished by this Act, shall continue as the <br /> City Planning and Zoning Commission of the City of Vero Beach <br /> created by this Act, and the members of said Commission as at <br /> present constituted shall continue to hold office for the term or <br /> terms for which they were appointed and until their successors are <br /> appointed and qualified; and whenever the term of office of any of <br /> the members of said Commission shall expire, or whenever there <br /> shall be a vacancy on said Commission for any other reason, the <br /> same shall be filled by appointment by the Mayor, subject to con- <br /> firmation by the City Council. \Vhere the appointment is for an <br /> unexpired term, the person so appointed shall serve for the re- <br /> mainder of the term of his predecessor and until his successor is <br /> appointed and qualified; and where the appointment is for the <br /> purpose of filling a vacancy caused by the expiration of a term of a <br /> member of the Commission, the person so appointed shall serve for <br /> a term of two years and until his successor is appointed and quali- <br /> fied. <br /> Section 104.
