2220 LAWS OF FLORIDA <br /> two successive weeks in some newspaper published in Indian River <br /> County, Florida. 'After such advertisement the Council may re- <br /> ceive bids and sell said bonds and it shall have the right to reject <br /> any and all bids and re-advertise the same, or any part thereof re- <br /> maining unsold; and if the bonds be not sold pursuant to such ad- <br /> vertisement, they may be sold at private sale at any time after the <br /> (late advertised for the reception of sealed bids, provided that no <br /> bonds issued under the authority of this Act shall be sold for less <br /> than ninety-five per cent of the par value thereof, with accrued in- <br /> terest, and provided further that no private sale thereof shall be <br /> made at a price lower than the best sealed bid received therefor, <br /> and no private sale shall be made of said bonds subsequent to thirty <br /> days after the advertised date for the reception of sealed bids. <br /> Section 118. It is the intention of the Legislature by virtue of <br /> the provisions of Sections 113 to 117, inclusive, of this Act to pre- <br /> scribe an independent and alternative authority for the City of <br /> Vero Beach to issue bonds for the purpose of refunding any out- <br /> standing obligations of said municipality or of the City of Vero <br /> Beach abolished by this Act which in any manner constitute an in- <br /> debtedness thereof. The refunding of any bonds under the pro- <br /> visions of said sections secured by special taxes, liens, assessments <br /> or benefits, as well as ad valorem taxes, shall not release such spe- <br /> cial taxes, liens or assessments, but the same shall in like manner <br /> constitute security for the payment of such refunding bonds; and <br /> the provisions of Sections 113 to 117, inclusive, of.this Act shall, <br /> without reference to any other Act of the Legislature, or any other <br /> provision in this Act, be full authority for the issuance, sale and <br /> exchange of bonds in said sections authorized, and no ordinance, <br /> resolution or proceeding in respect to the issuance of any bonds <br /> under the provisions of said sections shall be necessary, except such <br /> as required by the provisions of said sections; and it shall not be <br /> necessary to the validity of said bonds for any election to be called <br /> for the ratification of the issuance of said bonds by the voters of <br /> said City, nor for any other proceeding of any kind or character <br /> to be taken, except as provided and prescribed by Sections 113 to <br /> 117, inclusive, of this Act, and said bonds shall not be included in <br /> any debt or other limitation on the issuance of bonds by said City. <br /> Section 119. Should any rection or part of this Act be held <br /> unconstitutional or void for any reason by any court, the same <br /> shall affect only the particular section or part so held to be invalid <br /> and shall not affect in any manner the validity of any other part <br /> or parts of said Act. <br /> �� 1 <br />
