SECTION 00530 - EJCDC <br /> STANDARD FORM OF AGREEMENT <br /> BETWEEN OWNER AND CONTRACTOR <br /> ON THE BASIS OF A STIPULATED PRICE <br /> THIS AGREEMENT ("Agreement' or"Contract"), dated the day of in the <br /> year 20_ by and between Indian River County, a political subdivision of the State of Florida <br /> (hereinafter called OWNER) and .(hereinafter called <br /> CONTRACTOR). <br /> OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth, <br /> agree as follows: <br /> ARTICLE 1 WORK <br /> CONTRACTOR as an independent contractor and not as an employee shall furnish and complete <br /> all of the necessary labor, material, and equipment to perform the work as specified or indicated <br /> in the Contract Documents. The work is generally described as follows: <br /> A. CONTRACTOR shall complete all work as specified or indicated in the Contract <br /> Documents. The work is generally described as follows which shall include, but is not <br /> necessarily limited to the following. <br /> Indian River County (IRC) proposes to demolish and remove useless equipment, <br /> appurtenances, and piping and construct a new sludge recirculation system and tank <br /> truck filling facilities related to the existing sludge holding tanks at the Central Sub- <br /> regional Wastewater Treatment Plant Facility. An important element of the project will <br /> be the necessity for the contractor to conduct his work in a manner which will allow the <br /> continuation of sludge handling and removal operations at the treatment plant. There <br /> are two (2) existing concrete sludge holding tanks at the plant which store waste <br /> activated sludge which is pumped on a regular basis into tank trucks. <br /> The project consists of, but is not limited to: demolition and removal of all odor <br /> control system tanks, pumps, piping and appurtenances located west of the existing <br /> sludge holding tanks; demolition of useless piping, equipment, and appurtenances <br /> located on the concrete top of the sludge holding tanks as shown on the plans; <br /> demolition and removal of pumps, piping, and appurtenances on the south and east <br /> end of the existing sludge holding tanks as shown on the plans; relocation of the <br /> existing sludge drum thickener unit with necessary appurtenances and piping as shown <br /> on the plans; cleaning the interior of both sludge holding tanks; preparation and coating <br /> the interior walls and ceiling of each of the sludge holding tanks; preparation and <br /> painting of exterior walls of the sludge holding tanks; construction of a triplex <br /> recirculation pump system and tank truck filling facility along with necessary valves, <br /> piping, flow meter as shown on the plans; furnish and install level sensing units; provide <br /> all necessary electrical equipment and devices as shown on the electrical plans; <br /> provide all concrete slabs and site work shown on the plans; and all other items as <br /> required for an operational project. <br /> B. The OWNER shall have the option of direct purchase of all material and equipment for the <br /> project in accordance with Rule 12A-1.094 of the Florida Administrative Code. The <br /> contractor will be responsible for preparing the purchase documents for purchasing by the <br /> owner. The contractor will be responsible for scheduling, receiving, handling, and storage <br /> of all direct purchase material and equipment. <br /> 00530-1 <br /> 71 <br />
