Baird, County Administrator <br /> DEPARTMENT HEAD CONCURRENCE: <br /> Stan Boling, AICP <br /> Community Development Director <br /> FROM: Sasan Rohani, AICP <br /> Chief, Long-Range Planning <br /> DATE: February 26, 2014 <br /> SUBJECT: Authorization to Advertise for a Public Hearing to Consider Revising County <br /> Code Chapter 308, Indian River County Housing Assistance Program <br /> " It is requested that the data herein presented be given formal consideration by the Board of <br /> County Commissioners at its regular meeting of March 11, 2014. <br /> BACKGROUND <br /> Pursuant to the requirements of Section 420.907, F.S., and Rule 67-37.005, Florida <br /> Administrative Code (FAC), the Board of County Commissioners approved the County's first <br /> Local Housing Assistance Plan (Ordinance #93-13) on April 6, 1993. Subsequently, the Florida <br /> Housing Finance Agency approved the county's plan and authorized the disbursement of State <br /> Housing Initiatives Partnership (SHIP) Program funds. The County's Local Housing Assistance <br /> Program was then codified as Chapter 308 of the County Code. The portion of Chapter 308 <br /> related to the SHIP program has not been updated since it was adopted in 1993. <br /> Planning staff, in coordination with the County Attorney, has identified three types of changes <br /> that need to be made to Chapter 308. Because changes are needed, staff is requesting <br /> authorization from the Board to initiate the process to formally amend certain sections of Chapter <br /> 308. <br /> ANALYSIS <br /> Currently, there are three issues that require revisions to Chapter 308. First, since Chapter 308's <br /> adoption, the Florida Housing Finance Agency became the Florida Housing Finance Corporation <br /> and the Florida Administrative Code (FAC) citation changed from Chapter 9I-37 FAC to <br /> Chapter 67-37 FAC.
