2. Termination for Cause <br />Termination by the County for cause, default or negligence on the part of <br />the Applicant or firm shall be excluded from the foregoing provision; <br />termination costs, if any, shall not apply. The thirty (30) days advance <br />notice requirement is waived in the event of Termination for Cause. <br />D. Inconsistencies in Conditions <br />In the event there are inconsistencies between the General Contract Terms and <br />Conditions and the Special Contract Terms and Conditions, and other schedules <br />contained herein, the latter two shall take precedence. <br />E. Permit Fees <br />In accordance with Florida Statutes Section 218.80, the "Public Bid Disclosure <br />Act", Indian River County as OWNER is obligated to disclose all license, permit, <br />impact, or inspection fees that are payable to Indian River County in connection <br />with the construction of the Work by the accepted Applicant. All permit, impact, <br />or inspection fees payable to Indian River County in connection with the work on <br />this County project will be paid by Indian River County, with the exception of re- <br />inspection fees. The Applicant shall not include ANY PERMIT, IMPACT, NOR <br />INSPECTION FEES payable to Indian River County in the bid. <br />F. Invoicing and Payment <br />Except as may otherwise be provided by the contract to be executed by Indian <br />River County and the firm to which the contract for this work is awarded, the <br />following invoicing and payment conditions shall apply: <br />Applicant shall submit invoices for each payment requested; such <br />invoices to include a progress report and the percentage of performance <br />by the Applicant's employees working on the project. <br />The County will pay all invoices in accordance with the Local Government <br />Prompt Payment Act, F.S. 218.70 et. seq., unless any items thereon are <br />questioned, in which event payment will be withheld pending <br />verification of the amount claimed and the validity of the claim. The <br />Applicant shall provide complete cooperation during any such <br />investigation. <br />10 <br />74 <br />
