- M M <br />Director Davis advised it is our feeling that the church <br />should install that gate on their property, not in the county <br />R/W, and that the church be allowed to open that gate on Saturday <br />evenings, Sunday services, and Holy Days. That burden would be <br />on the church because it would be protecting somewhat their <br />private property rights so that people would not use the church <br />parking lot as a short cut on a daily basis. <br />Commissioner Bird did believe there is a minimal amount of <br />flow from the church on days other than Saturdays and Sundays and <br />wondered if possibly the flow is minimal enough that it would not <br />be disruptive to the neighborhood but yet it would enable someone <br />from Roseland to use that way on some other week day. <br />Director Davis believed that just the entrance on U.S.I <br />would not be such a bad situation on a non peak use. <br />Commissioner Scurlock asked if the gate is to protect the <br />church or the residents on 134th Street, and Director Davis felt <br />it would be mutually beneficial. <br />Attorney Vitunac did not think the county can get into <br />scheduling the opening of the gate on Holy Days. That is too <br />much an involvement in the private affairs of the church. He <br />felt the Board's decision should be to open it or close it, and <br />if it is closed with a temporary structure, then it is up to the <br />good faith of the church to keep it closed except on their most <br />busy days. <br />Gene Deinbach of Little Hollywood advised that when his <br />family goes to church, they go down U.S.I and then go back out <br />134th Street because it is plain "Hell" trying to get across <br />U.S.I. coming out. <br />Attorney Gregory Gore came before the Board representing St. <br />Sebastian Parish. He noted that originally the County Commission <br />was happy to accept $10,000 towards the paving of the road, and <br />now they are asking $15,000 which apparently represents 18.040 of <br />the total impact. He believed based on the figures, the church <br />is paying more than its fair share. The church agrees closure of <br />APR 101990 23 <br />
