Attorney Lloyd noted that this map covers the portion <br />running from 49th Avenue to 56th Avenue on the north side of 41st <br />Street and advised that when his clients first approached the <br />Planning Department to check on moving towards getting the <br />warehouses built, they were told the heavy red dotted line coming <br />through the middle of Mary Chesser's property was where the CLUP <br />line ended; however, after they took Mr. Loeper out there and <br />after further study, it was determined that line, on the map on <br />which the Board had voted, actually had fallen on the solid red <br />line in the middle of the Studer property. Mr. Lloyd emphasized <br />that there is an error there somewhere; they can't even read the <br />maps themselves, and there is no way his clients could have been <br />on notice. They will not argue notice today, however, but <br />basically would just ask the Board to change the property back to <br />where it was - Heavy Commercial and Industrial.. <br />Commissioner Scurlock asked if it is true that staff had <br />trouble determining between the dotted line and the solid line, <br />and Planner Loeper commented that he did not know where the <br />dotted line came from. When he got involved, he determined the <br />solid bine. He believed there may have been a question initially <br />regarding exactly where the line was, but the dotted line does <br />represent the present zoning boundary between the CH and IG. <br />Chairman Eggert noted that the solid red line goes right <br />down the center of someone's property, and Planner Loeper <br />explained that solid line represents the line that is shown on <br />the adopted Land Use Map, and that line is the one he was refer- <br />encing earlier when he explained that it had been adjusted to <br />correct for the Studer property which Attorney Marine was inquir- <br />ing about. <br />Attorney Lloyd agreed that solid line now has been moved to <br />the west to the next black dotted line. <br />Discussion continued at length as to exactly which dotted <br />line (red or black) was being referred to, and Chairman Eggert <br />believed Attorney Lloyd was asking that the property clear over <br />APR 101 1990 57 &OOK 1 „c b <br />
