particular site which would be no cost to the County; it would <br />also eliminate the problem of the cemetery using the facility; <br />and you would not have to run lines for wellfields across the <br />golf course because they could run down the property Line. <br />Attorney Vitunac explained the reason we are trying to get <br />the cemetery back is because the land is restricted by a clause <br />that it has to be used for P&R purposes. He noted that he wrote <br />a legal opinion that we could use the park property for a loca- <br />tion for the wastewater plant because the effluent was used on <br />the golf course, but there is also an opinion by him that the <br />water plant has no special use for the park more than for any <br />other land. <br />Commissioner Scurlock felt possibly we could proceed with <br />the state to release it for public purposes as opposed to a <br />private cemetery, and Attorney Vitunac agreed that approach could <br />be tried. <br />Utilities Director Pinto noted that staff looked at various <br />properties and came up with the 3 alternatives, one of which is <br />the piece that was in the original master plan. There are some <br />inherent problems with that piece; it is not so much running the <br />line out along the property line as running it to where you end <br />up placing the wells, and another fairly major concern is that <br />the brine discharge has to be sent to an area that will be <br />permittable, and with this piece, it is more difficult to get to <br />that area. <br />Commissioner Scurlock noted that we paid a lot of money for <br />the master plan and wished to know why Boyle thought it would be <br />a good site when they outlined it in the plan. <br />Director Pinto explained that the master plan chose the <br />general area; staff looked at available pieces; and at the time, <br />that was an available piece of ground.
