ORDINANCE NO. 2014 <br />WHEREAS, the Consultant, in coordination with staff, developed the proposed non- <br />residential impact fee schedules based upon the Consultant's report, impact fee update, and <br />Affordable Growth/Staff Scenario methodology. <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida that: <br />SECTION ONE: AMENDMENT OF CHAPTER TITLE X. <br />Title X, Impact Fees, of the Code of Indian River County is hereby amended as identified in <br />Section Two, below. All current residential impact fee rates shall remain unchanged until <br />specifically amended by ordinance of the Board of County Commissioners. <br />SECTION TWO: APPENDIX A, IMPACT FEE SCHEDULES <br />Appendix A, Non -Residential Impact Fee Schedules, of Title X, Impact Fees, of the county code <br />that contains the new non-residential impact fee schedules for the unincorporated Indian River <br />County and municipalities is attached. <br />SECTION THREE: CODIFICATION. <br />It is the intention of the Board of County Commissioners that the provision of this ordinance <br />shall become and be made part of the Indian River County Code, and that the sections of this <br />ordinance may be renumbered or re -lettered and the word ordinance may be changed to section, <br />article or such other appropriate word or phrase in order to accomplish such intention. <br />SECTION FOUR: SEVERABILITY. <br />If any section, sentence, clause, or phrase of this ordinance is held to be invalid or <br />unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect <br />the validity of the remaining portions of this ordinance. Furthermore, should the entirety of this <br />ordinance be held invalid or unconstitutional by any court of competent jurisdiction, it is the <br />intent of the Board of County Commissioners to reinstate the non-residential impact fees in <br />effect prior to the effective date of this ordinance. <br />SECTION FIVE: EFFECTIVE DATE. <br />The non-residential impact fee rates contained in Appendix A of this ordinance shall take effect <br />on May 5, 2014, except for the Jail and Veterinary Clinic impact fee rates that will be increasing <br />and which shall become effective on October 1, 2014. <br />This ordinance was advertised in the Vero Beach Press -Journal on the 7th day of April 2014, for <br />a public hearing to be held on the 22nd day of April 2014, at which time it was moved for <br />adoption by Commissioner , seconded by Commissioner , and <br />adopted by the following vote: <br />3 <br />38 <br />
