Chairman Zimmerman disclosed he had spoken to IRC Community <br />Development Director, Mr. Stan Boling, on this matter but he was fully capable of <br />rendering a careful and deliberate decision. <br />The secretary administered the testimonial oath to those present who wished to <br />speak at tonight's meeting on this matter. <br />Mr. Ryan Sweeney, IRC Current Development Senior Planner, reviewed the <br />information contained in his memorandum dated March 17, 2014 and gave a <br />PowerPoint presentation, copies of which are on file in the Commission Office. He <br />concluded with staffs recommendation that the PZC grant major site plan and <br />preliminary plat approval with the conditions set forth by staff. <br />Mr. Stephen Moler, representing the applicant, came forth and offered to answer <br />any questions. <br />Chairman Zimmerman inquired if there were any unusual site conditions <br />connected with the application that needed to be addressed. <br />Mr. Boling responded this was a very straight -forward matter since the property <br />had been approved for development before and it involved only a slight variation. <br />ON MOTION BY Mr. Brognano, SECONDED BY Dr. Day, <br />the members voted unanimously (6-0) to grant major <br />site plan and preliminary plat approval for a 53 unit <br />single-family residential development project to be <br />known as Diamond Court West with the conditions set <br />forth by staff. <br />Public Hearing <br />Chairman Zimmerman read the following into the record: <br />A. Consideration of Amendment of Land Development Regulations (LDRs) <br />Section 973.04, Section 973.06, and County Code Section 403.08 for <br />Nuisance Abatement Special Assessment [Legislative] <br />Attorney Dylan Reingold, IRC County Attorney, reviewed the information <br />contained in his memorandum dated March 19, 2014 which is on file in the Commission <br />Office. <br />Attorney Reingold explained under the existing code the process for nuisance <br />abatement was for the RC Code Enforcement Board and the Board of County <br />Commissioners (BCC) to determine the County could go out and abate whatever <br />nuisance was found on a property if there was a threat to public health, safety and <br />welfare or if there was irreversible and irreparable harm.
