l +� Has limited right-of-way width(30' —40') <br /> • Serves only commercially zoned properties <br /> • Functions as an alley or secondary access for property that fronts the commercial service <br /> street and an arterial street <br /> + Is designated as a "commercial service street" by resolution of the Board of County <br /> Commissioners <br /> These criteria are intended to ensure that any street designated as a "commercial service street" <br /> has the special characteristics and function of the subject segment of 50`h Avenue and has been <br /> specifically considered and designated by the Board. Staff's research indicates that the subject <br /> segment of 50th Avenue is the only street segment that meets the proposed definition of <br /> "commercial service street". If another street segment that meets the definition is identified in <br /> the future, that street could be considered by the Board of County Commissioners for designation <br /> (by resolution)as a"commercial service street". <br /> The ordinance also defines the appropriate yard designation for properties that front a <br /> commercial service street. As structured, the ordinance designates (by definition) a rear yard <br /> along the commercial service street frontage of a property that fronts a commercial street and an <br /> arterial street on opposite sides and designates the arterial street frontage of such property as a <br /> front yard. Under the proposed ordinance, a property that does not have "double frontage" on an <br /> arterial street and commercial service street has a front yard along its commercial service street <br /> frontage. In the case of a property that lies between US 1 and the subject segment of 50th <br /> Avenue, under the proposed ordinance that property will have a rear yard (10' setback) along its <br /> 50th Avenue frontage and a front yard (25' setback) along its US 1 frontage. Under the proposed <br /> ordinance, a property that lies on the west side of the subject segment of 50th Avenue will have a <br /> front yard(25' setback) along its 501h Avenue frontage. <br /> • Proposed Resolution <br /> The proposed ordinance requires that a "commercial service street" be designated as such by a <br /> resolution of the Board. Because the subject segment of 50'h Avenue meets the proposed criteria <br /> for a "commercial service street", and because the Board on April 15th indicated its support for <br /> the proposed LDR amendment and its application to 50th Avenue, staff has drafted a resolution <br /> for the Board's approval. As structured, the attached resolution acknowledges that the segment <br /> of 50`h Avenue from 87th Street to US 1 meets all the "commercial service street" criteria in the <br /> proposed ordinance, officially designates that segment as a commercial service street, and <br /> provides an effective date that coincides with the effective date of the proposed ordinance. <br /> RECOMMENDATION <br /> Staff recommends that, by separate motions,the Board of County Commissioners: <br /> 1) Adopt the proposed ordinance. <br /> 2) Adopt the attached resolution designating the segment of 501h Avenue from 87'h Street to <br /> US 1 as a "commercial service street", with an effective date that coincides with the <br /> effective date of the ordinance. <br /> FACO—unity D—Iopm ACwDev BCCU014 RM9 Icomm mt;dMic&&c 4 <br />
