It is requested that the Board of County Commissioners formally consider the following information at the Board's regular meeting on June 17, 2014. DESCRIPTION AND CONDITIONS The County has been petitioned by Melaina and Pablo Escobar, owners of a lot at 5880 Clubhouse Drive in Bent Pine Subdivision, for release of a 16-foot wide portion a 50-foot wide utility, drainage, and golf course maintenance easement on the rear of their lot. The purpose of the partial easement release request is to allow for construction of a pool and pool deck (see attached maps). ANALYSIS The request has been reviewed by AT&T; Florida Power& Light Corporation; Comcast Cable Services; the Indian River County Utilities Department;the County Road & Bridge and Engineering Divisions; the County surveyor; the Bent Pine Community Association Architectual Review Board; and the Bent Pine Golf Club. None of the utility providers or reviewing agencies expressed an objection to the requested partial release of easement. Therefore, it is staff's position that the requested partial easement release would have no adverse impact to(private)golf course maintenance or to public utilities being supplied to the subject property or to other properties. RECOMMENDATION Staff recommends that the Board, through adoption of the attached resolution, approve release of the 16- foot wide portion of the 50-foot utility, drainage, and golf course maintenance easement described in the resolution. 51
