This document was prepared by: <br />Indian River County Attorneys Office <br />1801 27th Street <br />Vero Beach, FL 32960 <br />(772) 226-1425 <br />ASSIGNMENT OF MAINTENANCE RESPONSIBILITY <br />THIS ASSIGNMENT, made this day of , 2014, by INDIAN <br />RIVER COUNTY, FLORIDA, a political subdivision of the State of Florida, <br />"County", whose mailing address is 1801 27th Street, Vero Beach, Florida 32960, <br />to INDIAN RIVER LAND TRUST, INC., a Florida nonprofit corporation, "Land <br />Trust" whose mailing address is 80 Royal Palm Pointe, Suite 301, Vero Beach, <br />Florida 32960. <br />WHEREAS, St. John's River Water Management District has declared two parcels of <br />property "the Block Property" to be surplus property and has conveyed them to the <br />County; and <br />WHEREAS, the Block Property is encumbered with a Conservation Easement that <br />sets forth certain maintenance obligations on the property; and <br />WHEREAS, the County has conveyed the Block Property to the Land Trust and the <br />Land Trust will maintain the Block Property together with other adjacent property owned <br />by the Land Trust; and <br />WHEREAS, the Land Trust accepts this Assignment of Maintenance Responsibility <br />required by the Conservation Easement; and <br />WHEREAS, notwithstanding anything otherwise provided or suggested in the <br />Conservation Easement, neither Indian River County nor the St. John's River Water <br />Management District has ever developed, adopted or approved a "Management Plan" for <br />the property other than as provided in agreement for mosquito control purposes with the <br />Indian River Mosquito Control District. <br />WITNESSETH that the County, for and in consideration of the sum of Ten <br />Dollars ($10.00) to it in hand paid by the Land Trust, receipt whereof is hereby <br />acknowledged, has assigned to the Land Trust, its successors and assigns <br />forever, the maintenance obligation over the described land lying and being in <br />Indian River County, Florida: <br />See Exhibit "A" attached hereto and made a part hereof. <br />The Indian River Land Trust Inc. hereby accepts assignment of the <br />maintenance obligations and to manage and maintain said property at its sole <br />cost and expense in accordance with the Perpetual Conservation Easement to <br />St. Johns River Water Management District recorded in Book , Page <br />of the Public Records of Indian River County, Florida. <br />23 <br />
