Mora, P.E., Public Works Directorcw.../ <br />FROM: Louise Gates, Land Acquisition Specialist <br />SUBJECT: Oslo Road and 66th Avenue — Northeast Corner <br />Right -of -Way Purchase and Dedication <br />Parcel I.D. #33-39-20-00001-0130-00001.0; #33-39-20-00001-0130-00004.0 <br />Owner: Audrey Graves Sexton/Three Dogs & A Horse, LLC <br />& Audrey Graves Sexton Trust <br />DATE: July 3, 2014 <br />DESCRIPTION AND CONDITIONS <br />The proposed right-of-way to be purchased is located on the east side of 66th Avenue, <br />north of Oslo Road, and consists of 68,815.2 square feet. As a condition of site plan <br />approval, Three Dogs & A Horse, LLC has also agreed to dedicate, without <br />compensation, a 5,758.78 square foot portion of its property to the County to be used as <br />right-of-way as required by County Code and depicted in Exhibit "C". <br />The parent parcel contains 16.98 acres and is zoned A-1. County staff proposes to <br />purchase the needed right-of-way for the price of $.46 per square foot ($20,037.60 per <br />acre), the same price Ms. Sexton paid for the property in December of 2013. <br />There are no appraisal fees or other expert fees associated with the purchase. <br />FUNDING <br />Funds for this expenditure are budgeted and available from Traffic Impact Fees/District <br />III/ROW/Oslo Road -66th Avenue Intersection- Acct # 10215341-066120-13005 <br />RECOMMENDATIONS <br />The Board's options include the following: <br />Option 1: Approve the transaction, purchasing the needed right-of-way for $$31,655 <br />Option 2: Reject the terms of the Agreement and continue to negotiate. <br />Staff recommends Option 1: The Board of County Commissioners approves the purchase <br />of the needed right-of-way at a price of $31,655 and authorizes the Chairman to sign the <br />Purchase and Sale Agreement. <br />1 <br />38 <br />
