LaPointe's Request to Modify the Rear Yard Setback for <br />Marina Lots 21 through 28 within the Marsh Island PD (Planned Development) <br />[PD -14-07-07 / 20020035-72508] <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its meeting of September 16, 2014. <br />DESCRIPTION AND CONDITIONS: <br />Kenneth J. & Claire K. LaPointe, owners of Lot 27 within the Marsh Island PD, have submitted an <br />application to modify the rear yard setback for the lots adjacent to the Marsh Island PD marina (Lots <br />21 — 28). The development is located on the north side of the CR 510 causeway, between the mainland <br />and the barrier island. <br />At its regular meeting of November 14, 2000, the Board of County Commissioners granted PD special <br />exception and conceptual PD plan approval for the Marsh Island PD project. That approved PD <br />special exception plan provided for 33 residential units on 27.20 acres, resulting in a density of 1.21 <br />units per acre. Subsequently, the developer received an administrative approval (AA -01-05-97) to <br />reduce the number of lots to 32 and increase the size of the project's stormwater pond. Project <br />subdivision improvements (i.e. roads, utilities, drainage system) have been completed, the project has <br />been platted, and 10 homes have been constructed on the overall project site. Of the 8 marina lots <br />(Lots 21 — 28), 4 have been developed with homes and 4 lots are currently vacant. <br />The LaPointes (owners of Lot 27) are now requesting a modification to an existing project setback <br />requirement. No increase in the number of lots or density is proposed, and no changes to any approved <br />project parameters, layout, or conditions are proposed. A copy of the November 14, 2000 staff report <br />for the Marsh Island project is attached for reference purposes (attachment #3). <br />As approved, the conceptual PD plan requires a 10' rear yard setback for the marina lots (Lots 21 — <br />28). At this time, the applicants are requesting an 8' rear yard setback for support columns for open <br />porches.
