Assistant County Attorney Kate Pingolt-Cotner provided background <br /> regarding the Department of Juvenile Justice (DJJ) adopting rules to <br /> the Florida Administrative Code, which shifted millions of dollars of <br /> the cost-sharing responsibility onto participating Counties within <br /> Florida. As a result, 25 Counties and the Florida Association of <br /> Counties decided to participate in a rule challenge against the Florida <br /> Department of Juvenile Justice; she questioned whether the Board <br /> wanted to: (1) continue as status quo; (2) contribute $1,000 in legal fees <br /> to show a unified front; or (3) file for a petition to intervene. She felt <br /> the County would be in the strongest position by participating in the <br /> rule challenge and contributing$1,000.00. <br /> ON MOTION by Commissioner Solari, SECONDED by Commissioner <br /> Zorc, the Board unanimously authorized the County to participate in <br /> the pending rule challenge, and authorized the contribution of <br /> $1,000.00 in litigation fees. <br /> 10:35 B. Demolition of Burnt Structure — Lot 5, Block 5, Glendale Lakes <br /> a.m. Subdivision 91146 th Avenue <br /> (memorandum dated_August 28, 2014) 284-289 <br /> - ----------------------------------------------------------------- <br /> Deputy County Attorney William DeBraal recapped his memorandum <br /> to provide background on the burnt structure located at 911 46th <br /> Avenue, and revealed that the current owners — Everette and Sherrie <br /> Powell, offered to pay $5,272.00 for the cost of demolition, but not the <br /> costs that had amassed before they became interested in the property. <br /> He recommended the Board accept the Powells' check, and authorize <br /> the Chairman to execute the Release and Satisfaction. <br /> ON MOTION by Commissioner Flescher, SECONDED by Vice <br /> Chairman Davis, the Board unanimously accepted the Powells' <br /> payment of $5,272.00 as full and final satisfaction of the total costs <br /> associated with the demolition of the structure on Lot 5, Block 5, <br /> Glendale Lakes Subdivision, and authorized the Chairman to execute <br /> the Release and Satisfaction for recordation in the Public Records of <br /> Indian River County, Florida to memorialize the satisfaction of the <br /> demolition recited in both the recorded Certificate of Building Official <br /> and Resolution No. 2013-120. <br /> C.
