The lease with the Rockridge POA is unique in that the County is <br /> simply the landowner of the property and had no hand in constructing the clubhouse on the <br /> property. The POA is generous in allowing other groups to use the building, but the <br /> County has not used the building in years. If it is the Board's desire to declare the property <br /> surplus, the County could convey the property to the POA with a deed restriction that the <br /> property remain for only community and recreational use in perpetuity. Since the POA is <br /> an active not for profit corporation, the conveyance could be done without compensation <br /> and without public bidding. If this option is chosen, the County would retain a utility and <br /> access easement to the lift station and generator buildings. In order to complete the <br /> conveyance, a County Deed and a resolution declaring the property to be surplus would <br /> need to be prepared and approved by the Board. <br /> Recommendation. Staff recommends that the Board authorize the Chairman to sign the <br /> attached Lease Renewal between Indian River County and the Rockridge Property <br /> Owners Association, Inc. to provide for the extension of the Lease until February 14, 2035. <br /> Staff further recommends the Board authorize the Chairman to execute the attached <br /> resolution approving the lease extension as required by Florida Statutes §125.38. <br /> Please contact me should you have any questions concerning this matter. <br /> 50 <br />
