received a letter from CIBA-GEIGY indicating that they would be <br />willing to trade a portion of the 40 acres for the parcels to the <br />north and to then donate the remainder of the 40 acres to the <br />County as an outright donation. <br />Commissioner Bird viewed this as a tremendous benefit to the <br />County and a win-win situation for the County. We have <br />appraisals on the parcels we are buying from Mr. Nyquist that are <br />in the $14,000 an acre range, and CIBA-GEIGY has appraisals on <br />their property in the $25,000 an acre range. Mr. Nyquist is <br />agreeable and is in the audience today. <br />Administrator Chandler explained that our option agreements <br />on these properties expire on April 25, 1990, which is the reason <br />for adding it to today's Agenda as an emergency item. We have <br />funding available in the M.S.T.U. The total price is $546,000. <br />Our appraisal on these properties is $14,000 an acre. The actual <br />cost for 37.1 acres is $14,685 per acre. We think it is a very <br />favorable proposition for the County and recommend that the <br />Commission authorize staff to proceed with the closing on these <br />properties on or before next Wednesday and then to proceed with <br />an approved agreement from CIBA-GEIGY. The County Attorney has <br />reviewed the letter that was FAX'd to us yesterday and indicated <br />that it is a binding commitment to the extent that it protects us <br />in going ahead with the closing on these properties and the <br />closing on the CIBA-GEIGY property sometime towards the end of <br />May. <br />Commissioner Scurlock felt that before taking any action <br />today, we need to clearly establish the emergency nature of <br />spending $546,000. Commissioner Bird was authorized by the <br />Commission to negotiate and try to acquire that parcel, and he <br />has been diligently pursuing that for over 3 years. The <br />emergency nature is the fact that we have less than one week to <br />make that decision and a commitment in order to acquire this <br />property.
