, <br />JUS! 5 1990 <br />BOOK ACE <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED by <br />Commissioner Wheeler, that the Board approve <br />Alternative No. 1, as recommended by staff. <br />Under discussion, Commissioner Bird wasn't sure he would <br />agree to give up 3 railroad crossings to get one. <br />Public Works Director Jim Davis advised that in his <br />discussions with Mr. Rodriguez of District #4 of the DOT about <br />our concerns on this setting a precedent in the future, Mr.. <br />Rodriguez said that each crossing is negotiable, and that if in <br />the future we did not have 3 crossings to give up for one, that <br />doesn't mean we should have to give up 3 for 1. It is basically <br />what do you have, what are you using., what is available to give <br />up, and if you have nothing to give up, you may get a new <br />crossing regardless. <br />Administrator Chandler emphasized that the recommendation is <br />not to give up 3 crossings, but to proceed with negotiation, and <br />if it becomes necessary, go to administrative hearings and <br />litigation. <br />Commissioner Bowman wondered why we are even proceeding with <br />the project for the one-way pair, and Director Davis explained <br />that since we have the right-of-way along that alignment, it <br />would be more economical to pursue the one-way pair project. <br />Commissioner Bowman pointed out that we had the right-of-way <br />because we got snookered into paying $200,000 for that strip of <br />property. <br />Commissioner Scurlock felt it was one of the best purchases <br />the County ever made. The strip of property is 6 miles long and <br />100 -feet wide. <br />Returning to the matter of the railroad crossings, <br />Commissioner Bird wanted staff to strongly pursue keeping as many <br />crossings as possible. <br />80 <br />
