r <br />JUN <br />BOOK 9 PAGE <br />ITEM #2: <br />Periodically the engineering department receives <br />right-of-way permit applications from private entities <br />requesting permission to place irrigation lines, gas <br />transmission lines, or other non -franchised facilities <br />within county rights-of-way. These facilities are not <br />intended for use by the general public. They are privately <br />owned and maintained. <br />Our current right-of-way permit conditions do not provide a <br />vehicle to off -set administrative costs in permitting the <br />installation of such facilities. This includes and is not <br />limited to plan review, permit processing, construction <br />inspection, periodic monitoring, and other related costs <br />involved in over seeing these facility installations. This <br />does not include access facilities such as driveway drainage <br />culverts or other items currently specified on the <br />right-of-way permit application. <br />ALTERNATIVES AND ANALYSIS <br />ALTERNATE FOR ITEM fl: <br />To implement a right-of-way permit condition by resolution <br />to require a cash bond to be held for a minimum period of <br />one year from the final completion date of the permitted <br />project and shall be at a rate of $1000.00 per lane with a <br />minimum charge of one lane for any open cutting of a- paved <br />road or portion thereof. <br />This alternative would only be approved in the event that <br />the jack & bore method for utility placement is not <br />practical. <br />ALTERNATE FOR ITEM #2 <br />To implement an annual right-of-way permit fee for <br />non -franchised right-of-way users at a rate of $500.00 per <br />mile based on 1/4 mile increments with a minimum charge of <br />1/4 mile or $125.00. . <br />The public works director and staff have determined this <br />rate to be reasonable and fair to off set the administrative <br />costs involved with these types of installations. <br />RECONP ENDATION <br />Staff recommends the adoption of this resolution immediately <br />and that both items 1 and 2 be incorporated into the <br />proposed right-of-way ordinance at such time that it is <br />adopted. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Wheeler, the Board unanimously adopted <br />Resolution 90-75 on behalf of the Dept. of Public <br />Works, establishing certain fees and charges for use of <br />county road right-of-way and for open cutting of paved <br />county roads. <br />82 <br />
