BOOK � t e.rlJeJ <br />RIGHT-OF-WAY ACQUISITION ALONG 74TH AVENUE - LOT #16 IN WESTLAKE <br />ESTATES SUBDIVISION <br />The Board reviewed the following memo dated 5129/90: <br />TO: James Chandler <br />County Administrator <br />FROM: James W. Davis, P.E. <br />Public Works Directo <br />SUBJECT: Right -of -Way Acquisition along 74th Avenue <br />Pat Luther - Owner of lot 16 in Westlake <br />Estates Subdivision <br />RE: Letter from J. Thomas Schlitt to <br />James W. Davis, dated May 15, 1990 <br />DATE: May 29, 1990 <br />DESCRIPTION AND CONDITIONS <br />On October 24, 1989, the Board approved purchase of lot 17, <br />Westlake Estates Subdivision, from Phil and Debbie Delange, due <br />to the County's need for 55' of additional right-of-way along <br />74th Avenue South of SR 60. The total lot depth was 156.041, and <br />the 55' needed substantially reduced the lot size. <br />The only other platted lot within Westlake Estates <br />Subdivision that has frontage on 74th Avenue (Rangeline Road) is <br />lot 16, owned by Pat and Linda Luther. The Luther's have <br />recently tried to sell their lot, however prospective buyers are <br />aware of the County's right-of-way needs and are refusing to <br />purchase it. <br />Mr. and Mrs. Luther, through their agent Tom Schlitt, are <br />requesting that the County purchase lot 16 (1.05 acres) for--the- <br />asking price of $25,000.00. <br />ALTERNATIVES AND ANALYSIS <br />The paving and capacity expansion of 74th Avenue between SR <br />60 and 16th Street is included in the County's 20 -Year Road <br />Improvement Program. The Thoroughfare Plan right-of-way for 74th <br />Avenue (801) in this area should be protected from encroachments. <br />At this time, Mr. & Mrs. Luther are offering to sell the entire <br />lot to the County. Based on information available, staff is of <br />the opinion that a fair purchase price for the entire lot would <br />be $25,000.00 as requested by the Luther's. <br />Alternative No. 1 <br />Offer to purchase the entire lot at $25,000.00 plus minor <br />closing fees. After the 80' right-of-way is secured, the <br />County could resell the remainder for approximately <br />$17,000.00.based on the prorated acreage values. The net <br />cost to the County would be approximately $8,000.00. <br />Alternative No. 2 <br />As per the existing County code, the lot owner would be <br />requested to dedicate to the County, without compensation, <br />35' of right-of-way to meet local road standards and be <br />compensated for the additional 20' needed to meet collector <br />road standards. The property owner would be constrained to <br />build the size of single family home on the land that he <br />wishes due to setback deed restrictions. <br />84 <br />
