The subject <br />property is zoned RS -3, Single Family Residential (up to 3 units <br />per acre) and has an L-1 Low -Density Residential (up to 3 units <br />per acre) land use designation. The proposed building density is <br />1.48 units per acre. All roads, drainage and utilities easements <br />and facilities are to be dedicated to the County. <br />At its regular meeting of October 26, 1989, the Planning and <br />Zoning Commission granted preliminary plat approval for the <br />subdivision. A land development permit for project construction <br />was subsequently issued. The owner's agent, James Beindorf, on <br />behalf of the owner, Sexton Properties of Vero Beach, Inc., is now <br />requesting final plat approval and has submitted the following: <br />1. a final plat in conformance with the approved preliminary <br />plat; <br />2. a Warranty/Maintenance Agreement and Bill of Sale for the <br />complete, publicly dedicated required improvements; <br />3. an insurance bond as a security arrangement acceptable to the <br />County Attorney's Office to guarantee the Warran- <br />ty/Maintenance Agreement; <br />4. a certified cost estimate for the constructed required <br />improvements. <br />ANALYSIS: <br />The required improvements have been constructed by the developer. <br />The developer has submitted a Warranty/Maintenance Agreement and <br />posted sufficient security to guarantee the performance of the <br />completed improvements that are dedicated to the County. All <br />applicable requirements regarding.. final plat approval have been <br />satisfied. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant <br />final plat approval for the Old Sugar Mill Estates - Unit 7 <br />Subdivision, and accept the submitted Warranty/Maintenance Agree- <br />ment and posted security.! <br />ON MOTION by Commissioner Bird, SECONDED by Commis- <br />sioner Scurlock, the Board.unanimously granted Final <br />Plat Approval for Old Sugar Mill Estates, Unit 7, and <br />accepted the submitted Warranty/Maintenance Agreement <br />and posted security, as recommended by staff. <br />COPY OF SAID AGREEMENT IS ON FILE IN OFFICE OF CLERK TO THE <br />15 BOOK O F'A "E ,30 <br />JUN 12" 1990 <br />
