JUN <br />The applicant has submitted information satisfying all of the <br />above criteria. This information has been reviewed and approved <br />by the County Attorney's Office. <br />The following reviewing agencies and utility providers have <br />reviewed the request and have no objection to the plat vacation: <br />Indian River County Utilities and Public Works, City of Vero Beach <br />Utilities, Southern Bell, Florida Cablevision, and Florida Power <br />and Light. The plat to be vacated does not affect any public or <br />private facilities or access rights other than those related to <br />the plat being vacated. <br />Thus all requirements concerning plat vacation have been met, and <br />staff has no objections to the requested vacation. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt the <br />attached resolution vacating the Whistlewood Subdivision as <br />recorded in Plat Book 10, Page 45 Public Records of Indian River <br />County, Florida.; <br />Chairman Eggert believed the mall DRI is still pending and <br />asked if this plat is vacated and the mall doesn't come in, would <br />they have to go back and replat. <br />Planning Director Boling confirmed that if they wanted to <br />develop it as single family, they would have to replat; however, <br />it is zoned RM -6 at this time, and it could be redeveloped as <br />something else. He noted that this vacation is not dependent on <br />the mall being approved. <br />The Chairman asked if anyone present wished to be heard. <br />Attorney Charles McKinnon came before the Board and advised <br />that his firm represents the applicant, Ty Tarby, Trustee. They, <br />of course, agree with staff's recommendation and would ask that <br />the Board vacate the plat. <br />It was determined that no one else wished to be heard, and <br />the Chairman thereupon closed the public hearing. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Bird, the Board adopted Resolution 90-77 <br />approving the vacating of the Plat of Whistlewood <br />Subdivision as requested by Ty Tarby, Trustee. <br />25 BOOK F°Jca 1U <br />
