K. Appointment to the Ad Hoc Fire Committee <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Wheeler, Commissioner Bird being absent, <br />the Board unanimously (4-0) appointed Arthur Harris <br />to the Ad Hoc Fire Committee replacing Reverend <br />Johnny Green. <br />LEASE - FIREARMS RANGE <br />The Board reviewed memo from County Attorney Vitunac and <br />letter from Attorney Ronald Sales: <br />TO: Board of County Commissioners <br />FROM: Charles P. Vitunac - County Attorney <br />DATE: June 14, 1990 (dictated 6/13/90) <br />RE: LEASE - FIREARMS RANGE <br />The attached proposed lease, already executed by the St. <br />Johns Vater Management District, would lease approximately, <br />50 acres of land near 20 -Mile Bend and State Road 60 to the <br />County for use as a firearms range. The lease would be for <br />an initial term of 15 years at no cost. The County would be <br />obligated to develop the property In a manner acceptable to <br />the District within two years or the lease will terminate. <br />The adjoining property owners, Ronald Sales and Bi l l Cobb, <br />have noticed the County that they intend to file suit to <br />prevent the development of this property as a shooting <br />range. Their complaint is based on various environmental <br />claims and on safety and nuisance issues. The District has <br />indicated that it will spend no`mon1es defending any lawsuit <br />based on the lease, and that any such defense would be <br />solely the County's responsibility. The County's position, <br />per Commissioner Bird, Is that the County has no better site <br />for the range and is willing to contest this suit, since to <br />do otherwise would mean that there would be no shooting <br />range in Indian River County. <br />ACTION REQUESTED: Staff recommends approval of the lease <br />and authorizing for the County Attorney's Office to defend <br />the lease in court, If necessary. <br />15lu <br />JUN 2 61990 <br />
