The proposed Lease Agreement provides for an initial term of five <br />(5) years beginning on the date the option is exercised at an <br />annual rental of $3,600 to:be paid in equal monthly installments <br />on the first day of the month, in advance, to Indian River County. <br />An option in the lease provides for an extension of the lease for <br />four. (4) additional five. (5) year terms by giving the County <br />written notice at least six (6) months prior to the end of the <br />current term. <br />The annual rental for the first five year extension is increased <br />to $4,140, the second extension to $4,761, the third to $5,475, <br />and the fourth to'$6,297. If at the end of the fourth five year <br />extension term the Agreement has not been terminated by either <br />party by giving written notice six months in advance, the Agreement <br />continues in force upon the same terms and conditions for period <br />of one (1) year and for annual terms thereafter until terminated <br />by either party by giving six months written notice prior to the <br />end of the term. Monthly rental for this period would be equal to <br />the rent paid for the last month of the fourth five year extension. <br />RECOMMENDATION: <br />Staff recommends the Board of County Commissioners approve the <br />proposed Lease Agreement with BellSouth Mobility and authorize the <br />Chairman to execute the referenced lease. <br />Commissioner Bird commented that he has a problem. He <br />agreed that this tower is desperately needed in this county and <br />he is all in favor of it; however, the way he reads this lease, <br />it sounds as if you are leasing them just this little bit of land <br />for their tower, but in Paragraph 22, it says that, at the <br />tenant's option, they may erect either a self supporting tower or <br />a guyed tower. If they should choose to erect a guyed tower, <br />then they will need an additional 315' easement in all direc- <br />tions, and if they do that, we are tying up a property of about <br />10 acres in size, and in that case, he felt we are not getting <br />enough money. <br />Director Wright advised that we have encouraged them to go <br />with the free standing type, which we feel would be more appro- <br />priate, and he further noted that Ron Brooks, Director of the <br />Solid Waste Disposal District, felt if we could have some say <br />about where guy wires could be placed, this area might be of use <br />to the SWDD. ` <br />Commissioner Bird believed even if it is an unguyed tower, <br />you need some drop zone, and he wished to know if this land -is <br />owned by the Utilities Department. <br />35 BOOK r'A� <br />
