DESCRIPTION AND CONDITIONS: <br />Vero Stor-All has submitted a petition for right-of-way abandonment <br />for a portion of 4th Place between Old Dixie Highway and the <br />Florida East Coast Railroad. The segment proposed for abandonment <br />is approximately 55' in length and contiguous to a portion of 4th <br />Place of right of way previously abandoned by the Board of County <br />Commissioners on November 22, 1988. <br />ALTERNATIVES AND ANALYSIS: <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having jurisdiction within the right-of-way. All <br />reviewing agencies have recommended approval of the abandonment, <br />with the provision that a 30' wide utilities and -drainage easement <br />be retained. A similar condition was applied to the adjacent 4th <br />Place segment abandoned in 1988. The proposed resolution would <br />retain an easement that lines up with the adjacent.. existing <br />easement retained as part of the 1988 abandonment. This portion of <br />4th Place is not part of the roadway system as noted on the County <br />Thoroughfare Plan, and -is not needed for the thoroughfare system. <br />The 55' segment proposed for abandonment will square -off the <br />petitioner's property. The petitioner will use the property to <br />expand the existing business, if the abandonment is approved. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to the portion <br />of 4th Place right-of-way described in Exhibit A, and that the <br />Chairman of the Board of County Commissioners be authorized to <br />execute the attached resolution (Attachment #3), with the following <br />condition: <br />1. That a 30' drainage and utilities easement be reserved along <br />the north side of the subject right-of-way as described in <br />Exhibit B of the Resolution. <br />Chairman Eggert asked if this is going to end up with the <br />road dead -ending into their property, and Planning Director Stan <br />Boling confirmed that it will. <br />The Chairman opened the Public Hearing, and asked if anyone <br />wished to be heard on this matter. There being none, she closed <br />the Public Hearing. <br />ON MOTION by Commissioner Wheeler, SECONDED by <br />Commissioner Bird, the Board unanimously (4-0, <br />Commissioner Scurlock being absent) adopted Resolution <br />90-90A, providing 'for the closing, abandonment, and <br />vacation of a portion of 4th Place. <br />Ur, ® 17 BOOK 80 F�.ul:7 <br />
